Lynch to advise on same-sex marriage validity in R.I.

PROVIDENCE -- Attorney General Patrick C. Lynch expects to issue an interpretation of the state's marriage law on Monday, in part because a gay couple planning to wed in neighboring Massachusetts asked him if their union would be recognized here.

Officials in the Bay State are expecting a flood of out-of-state gay couples to apply for marriage licenses Monday, the first day same-sex unions will be legal.

Massachusetts Gov. Mitt Romney has said state law prohibits couples from marrying there if the marriage would be illegal in their home state, and no other state recognizes same-sex marriages.

A small number of communities in Massachusetts have said they will grant licenses to out-of-state couples, despite Romney's instructions.

Massachusetts's highest court ruled in November that it is unconstitutional to bar same-sex couples from marrying. Rhode Island's law is unclear on the issue, and Lynch has not said how he will interpret it.

Lynch received a letter from a man yesterday, asking whether his marriage to his partner in Massachusetts would be legal or void in Rhode Island, said Lynch spokesman Michael Healey. He would not identify the man who sent the letter.

"We have a thoughtful letter asking the attorney general some very straightforward questions," Healey said. "It's one inquiry asking how the law is interpreted in Rhode Island."

Healey said the couple's inquiry was the first Lynch had received. However, the attorney general's office has been reviewing state law for months in anticipation of such a query, Healey said.

Rhode Island lawmakers are considering opposing bills on same-sex marriages. Among the measures, one would define marriage as between a man and a woman, while another would legalize same-sex marriages and recognize such unions performed in another state.
